1. Data protection at a glance
General information
The following information provides a simple overview of what happens to your personal data when you visit this website. Personal data is any data that can be used to identify you personally. Detailed information on data protection can be found in the privacy policy set out below.
Data collection on this website
Who is responsible for data collection on this website?
Data processing on this website is carried out by the website operator. You can find their contact details in the section “Information about the controller” in this privacy policy.
How do we collect your data?
Some of your data is collected when you provide it to us. This may, for example, be data that you enter in a contact form. Other data is collected automatically or with your consent by our IT systems when you visit the website. This is mainly technical data (e.g. internet browser, operating system or time of the page view). This data is collected automatically as soon as you enter this website.
What do we use your data for?
Part of the data is collected to ensure that the website is provided without errors. Other data may be used to analyse your user behaviour.
What rights do you have regarding your data?
You have the right to receive information about the origin, recipient and purpose of your stored personal data free of charge at any time. You also have the right to request the correction or deletion of this data. If you have given your consent to data processing, you can revoke this consent at any time for the future. You also have the right to request the restriction of the processing of your personal data under certain circumstances. Furthermore, you have the right to lodge a complaint with the competent supervisory authority. You can contact us at any time with regard to this and any other questions on the subject of data protection.
2. Hosting and Content Delivery Networks (CDN)
Strato
We host our website with Strato. The provider is Strato AG, Pascalstraße 10, 10587 Berlin, Germany (“Strato”). When you visit our website, Strato collects various log files including your IP address. Further information can be found in Strato’s privacy policy: https://www.strato.de/datenschutz/. Strato is used on the basis of Art. 6(1)(f) GDPR. We have a legitimate interest in presenting our website as reliably as possible. If corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR; consent can be revoked at any time.
Data processing agreement
We have concluded a data processing agreement (DPA) for the use of the above-mentioned service. This is a contract required by data protection law which ensures that Strato processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.
3. General information and mandatory information
Data protection
The operators of this website take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this privacy policy. When you use this website, various personal data is collected. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this happens. Please note that data transmission over the internet (e.g. when communicating by email) may have security gaps. Complete protection of data against access by third parties is not possible.
Information about the controller
The controller responsible for data processing on this website is:
Bandov Immobilien
Owner: Boris Bandov
Neue Mainzer Str. 84
60311 Frankfurt am Main, Germany
Email: info@bandov-immobilien.de
Phone: +49 69 34876820
Website: www.bandov-immobilien.de
The controller is the natural or legal person who alone or jointly with others decides on the purposes and means of processing personal data (e.g. names, email addresses, etc.).
Storage period
Unless a more specific storage period is stated in this privacy policy, your personal data will remain with us until the purpose for which it was processed no longer applies. If you assert a justified request for deletion or revoke your consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g. retention periods under tax or commercial law); in the latter case, deletion will take place once these reasons no longer apply.
Note on data transfer to the USA and other third countries
Among other things, we use tools from companies based in the USA or other third countries that are not secure under data protection law. If these tools are active, your personal data may be transferred to these third countries and processed there. We would like to point out that a level of data protection comparable to that in the EU cannot be guaranteed in these countries. For example, US companies are obliged to hand over personal data to security authorities without you as the data subject being able to take legal action against this. It can therefore not be ruled out that US authorities (e.g. intelligence services) process, evaluate and permanently store your data located on US servers for monitoring purposes. We have no influence on these processing activities.
Revocation of your consent to data processing
Many data processing operations are only possible with your express consent. You can revoke consent you have already given at any time. The lawfulness of the data processing carried out until the revocation remains unaffected by the revocation.
Right to object to data collection in special cases and to direct marketing (Art. 21 GDPR)
IF DATA PROCESSING IS BASED ON ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA AT ANY TIME ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA CONCERNED UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING THAT OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS (OBJECTION UNDER ART. 21(1) GDPR). IF YOUR PERSONAL DATA IS PROCESSED FOR DIRECT MARKETING PURPOSES, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA FOR SUCH MARKETING; THIS ALSO APPLIES TO PROFILING INSOFAR AS IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR DIRECT MARKETING PURPOSES (OBJECTION UNDER ART. 21(2) GDPR).
Right to lodge a complaint with the competent supervisory authority
In the event of violations of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the member state of their habitual residence, their place of work or the place of the alleged infringement. The right to lodge a complaint is without prejudice to any other administrative or judicial remedies.
Right to data portability
You have the right to have data that we process automatically on the basis of your consent or in fulfilment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done insofar as it is technically feasible.
SSL or TLS encryption
For security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us as the site operator, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line. If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.
Information, deletion and correction
Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipient and the purpose of the data processing and, if applicable, a right to correction or deletion of this data. You can contact us at any time with regard to this and other questions on the subject of personal data.
Right to restriction of processing
You have the right to request the restriction of the processing of your personal data. You can contact us at any time to do so. The right to restriction of processing exists in the following cases:
If you dispute the accuracy of your personal data stored by us, we usually need time to verify this. For the duration of the review, you have the right to request the restriction of the processing of your personal data.
If the processing of your personal data happened or is happening unlawfully, you can request the restriction of data processing instead of deletion.
If we no longer need your personal data, but you need it to exercise, defend or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion.
If you have lodged an objection pursuant to Art. 21(1) GDPR, a balance must be struck between your interests and ours. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.
If you have restricted the processing of your personal data, this data – apart from its storage – may only be processed with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or a member state.
Objection to advertising emails
We hereby object to the use of contact data published as part of the imprint obligation for sending unsolicited advertising and information material. The operators of the website expressly reserve the right to take legal action in the event of unsolicited advertising information, such as spam emails.
4. Data collection on this website
Cookies
Our website uses so-called “cookies”. Cookies are small text files and do not cause any damage to your device. They are stored either temporarily for the duration of a session (session cookies) or permanently (permanent cookies) on your device. Session cookies are automatically deleted at the end of your visit. Permanent cookies remain stored on your device until you delete them yourself or they are automatically deleted by your web browser. In some cases, cookies from third-party companies may also be stored on your device when you enter our site (third-party cookies). These enable us or you to use certain services of the third-party company. Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them. Other cookies are used to evaluate user behaviour or display advertising. Cookies that are required to carry out the electronic communication process, to provide certain functions you have requested or to optimise the website (e.g. cookies to measure the web audience) are stored on the basis of Art. 6(1)(f) GDPR, unless another legal basis is stated. The website operator has a legitimate interest in storing cookies for the technically error-free and optimised provision of its services. If consent to the storage of cookies has been requested, the cookies concerned are stored exclusively on the basis of this consent (Art. 6(1)(a) GDPR); consent can be revoked at any time. You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be limited. If cookies are used by third-party companies or for analysis purposes, we will inform you of this separately in this privacy policy and, if necessary, request your consent.
Consent with CookieYes
Our website uses the WordPress plugin CookieYes to obtain your consent to the storage of certain cookies in your browser or to the use of certain technologies and to document this in compliance with data protection law. The plugin runs on our own server. Your consent decision is stored in a cookie (“cookieyes-consent”) in your browser so that the request does not appear again on every page view. Your data is not transmitted to the provider of the plugin. You can change your settings or revoke your consent at any time via the cookie icon on the website. The plugin is used to obtain the legally required consent for the use of certain technologies. The legal basis for this is Art. 6(1)(c) GDPR.
Language selection
Our website is available in German and English. We use the WordPress plugin Polylang to switch languages. To display pages in the language you last selected, a cookie (“pll_language”) with a lifetime of up to one year is stored in your browser. It contains only the language code and no other personal data. It is stored on the basis of Art. 6(1)(f) GDPR and Section 25(2) TDDDG, as it is technically necessary to display the website in the way you requested.
Server log files
The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are: browser type and version, operating system used, referrer URL, host name of the accessing computer, time of the server request and IP address. This data is not merged with other data sources. This data is collected on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimisation of its website – for this purpose, the server log files must be recorded.
Contact form
If you send us enquiries via a contact form (e.g. contact request, property enquiry, search criteria, rental request or valuation request), the information you provide in the form, including the contact details you enter, will be stored by us for the purpose of processing the enquiry and in case of follow-up questions. The forms are provided on our own server using the WordPress plugin WPForms; your details are sent to us by email. We do not pass on this data without your consent. This data is processed on the basis of Art. 6(1)(b) GDPR if your enquiry is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective processing of enquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if this has been requested; consent can be revoked at any time. The data you enter in the contact form will remain with us until you ask us to delete it, revoke your consent to storage or the purpose for data storage no longer applies (e.g. after your enquiry has been processed). Mandatory statutory provisions – in particular retention periods – remain unaffected.
Enquiries by email, phone or WhatsApp
If you contact us by email, phone or WhatsApp, your enquiry, including all resulting personal data (name, enquiry), will be stored and processed by us for the purpose of handling your request. We do not pass on this data without your consent. Processing is based on Art. 6(1)(b) GDPR if your enquiry is related to the performance of a contract or is necessary for the implementation of pre-contractual measures; otherwise it is based on our legitimate interest in the effective processing of enquiries addressed to us (Art. 6(1)(f) GDPR). If you contact us via WhatsApp, data is also processed by WhatsApp Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland; their privacy policy applies in addition. The data you send to us will remain with us until you ask us to delete it, revoke your consent to storage or the purpose for data storage no longer applies. Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.
5. Plugins and tools
Google reCAPTCHA
We use “Google reCAPTCHA” (“reCAPTCHA”) on this website. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland. The purpose of reCAPTCHA is to check whether data entered on this website (e.g. in a contact form) is entered by a human or by an automated program. To do this, reCAPTCHA analyses the behaviour of the website visitor based on various characteristics. This analysis starts as soon as you interact with the website (e.g. by scrolling, clicking or filling in a form). For the analysis, reCAPTCHA evaluates various information (e.g. IP address, time spent on the website or mouse movements made by the user). The data collected during the analysis is forwarded to Google. The reCAPTCHA analyses run entirely in the background. The data is stored and analysed on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in protecting its website from abusive automated spying and from SPAM. If corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and Section 25(1) TDDDG; consent can be revoked at any time. For more information about Google reCAPTCHA, please refer to the Google Privacy Policy and Terms of Service: https://policies.google.com/privacy?hl=en and https://policies.google.com/terms?hl=en. The company is certified under the EU-US Data Privacy Framework (DPF). The DPF is an agreement between the European Union and the USA intended to ensure compliance with European data protection standards for data processing in the USA. Further information can be obtained from the provider at: https://www.dataprivacyframework.gov/participant/5780.
Google Fonts (local hosting)
This site uses so-called Google Fonts provided by Google for the uniform display of fonts. The Google Fonts are installed locally. No connection to Google servers is established. Further information on Google Fonts can be found at https://developers.google.com/fonts/faq and in Google’s privacy policy: https://policies.google.com/privacy?hl=en.
Font Awesome (local)
This site uses Font Awesome for the uniform display of icons. Font Awesome is installed locally. No connection to the servers of Fonticons, Inc. is established. Further information can be found in the Font Awesome privacy policy: https://fontawesome.com/privacy.
6. Affiliate links
On some pages of this website we refer to partner offers via so-called affiliate links (e.g. the No Limit Club via the Digistore24 platform and the valuation service “Der Gutachter” via the SachNet partner portal). If you click on such a link and purchase a product or service from the partner, we receive a commission. This does not result in any additional costs for you. So that the referral can be attributed, the link contains a partner ID; the respective partner may also use cookies or similar technologies on its own website. The respective partner is solely responsible for data processing on its website; its privacy policy applies. We ourselves do not receive any personal data about you, only information about referred transactions. The legal basis is Art. 6(1)(f) GDPR; our legitimate interest lies in the settlement of commissions.
7. Customer and contract data
We collect, process and use personal customer and contract data to establish, define the content of and amend our contractual relationships, in particular in the context of brokerage and advisory mandates (e.g. name, address, contact details, information on search criteria, financing and the property). We collect, process and use personal data on the use of this website (usage data) only insofar as this is necessary to enable the user to use the service. The legal basis for this is Art. 6(1)(b) GDPR. Insofar as necessary to carry out the mandate, we pass on data to third parties involved, such as owners or sellers, notaries, financing partners or valuers. As a real estate broker, we are also obliged under the German Anti-Money Laundering Act (GwG) to verify the identity of our contractual partners and to retain the corresponding documents; in this respect, processing is based on Art. 6(1)(c) GDPR. The customer data collected will be deleted after completion of the mandate or termination of the business relationship and expiry of any statutory retention periods. Statutory retention periods remain unaffected.
